These Terms of Service ("Terms") govern your access to and use of the RCICMASTER websites, consultant dashboard, client portal, mobile apps, LMS courses, and related services (together, the "Service"). The Service is operated by RCICMASTER, 145 Church Street, Unit 5, Toronto, Ontario, M5B 1Y4, Canada ("RCICMASTER", "we", "us", or "our").

By creating an account, starting a free trial, purchasing a plan or course, or otherwise using the Service, you agree to these Terms. If you use the Service on behalf of a firm or company, you confirm that you have authority to bind that firm, and "you" includes that firm. If you do not agree, do not use the Service.

1. What the Service is

RCICMASTER is a practice management software platform for Canadian immigration professionals. It includes tools for client and case management, document collection, questionnaires, retainer agreements, trust ledger records, payment requests, meetings, messaging, team access, IRCC news, government form helpers, AI-assisted drafting, and training courses.

RCICMASTER is a software provider only. We are not a law firm, not an immigration consultancy, and not a party to any relationship between you and your clients. We do not provide legal or immigration advice, we do not represent anyone before Immigration, Refugees and Citizenship Canada (IRCC) or any other authority, and we do not guarantee the outcome of any application.

2. Accounts and eligibility

  • You must be at least 18 years old and able to enter a binding contract.
  • Consultant accounts are intended for licensed Regulated Canadian Immigration Consultants (RCICs), their staff, and other authorized immigration professionals. We may ask you to verify your licence and may refuse, limit, or close any account at our discretion.
  • You must give accurate information and keep it up to date, including your RCIC number, firm details, and billing details.
  • You are responsible for all activity under your account and your team members' accounts, and for keeping passwords and sign-in methods secure. Tell us immediately at info@rcicmaster.ca if you suspect unauthorized access.

3. Your professional responsibilities

You remain solely responsible for your professional practice and for everything you do with the Service, including:

  • Complying with the College of Immigration and Citizenship Consultants (CICC) Code of Professional Conduct, the College Act, trust account rules, and all other laws and regulations that apply to you.
  • The accuracy of every application, form, letter, retainer agreement, invoice, and document you prepare, submit, or send, whether or not the Service helped create it.
  • Maintaining your official trust account at your financial institution. The trust ledger in the Service is a record-keeping aid only; it is not a bank account, it does not hold funds, and it does not replace your own reconciliations or records required by the CICC.
  • Reviewing all AI-generated content, government form helpers, templates, CRS calculations, legislation summaries, and IRCC news before relying on them. These features may be incomplete, out of date, or wrong, and are provided for convenience only.
  • Having a lawful basis and your clients' consent to upload, store, and process their personal information in the Service.

4. Acceptable use

You agree not to:

  • Use the Service for anything unlawful, fraudulent, misleading, or in breach of professional rules, including unauthorized immigration practice.
  • Upload malware, or attempt to probe, scan, break, or bypass the security or access controls of the Service.
  • Copy, resell, sublicense, frame, scrape, or reverse engineer the Service, or use it to build a competing product.
  • Share accounts, or give access to anyone who is not an authorized member of your team.
  • Send spam or unsolicited messages through email, WhatsApp, SMS, or any other channel connected to the Service.
  • Interfere with other users or place an unreasonable load on our systems.

We may investigate suspected violations and may suspend or terminate access immediately, without notice and without refund.

5. Free trials

Some plans include a free trial. Unless you cancel before the trial ends, your selected plan starts automatically and the payment method on file is charged at the end of the trial. It is your responsibility to cancel in time. Trial charges that have been billed are not refundable. We may change, limit, or end free trial offers at any time, and each person or firm may use a free trial only once.

6. Plans, billing, and renewals

  • Subscription plans are billed in advance, monthly or yearly as selected, in Canadian dollars unless stated otherwise.
  • Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. You authorize us and our payment processor (Stripe) to charge your payment method for each renewal and for any add-ons, storage upgrades, courses, marketing services, or other purchases you make.
  • Applicable GST/HST or other taxes are added at checkout and are your responsibility.
  • If a payment fails, we may retry the charge. Your account may enter a short grace period, after which we may restrict or suspend access until the balance is paid.
  • We may change prices or plan features. Price changes take effect at your next renewal after we give notice by email or in the dashboard. Continuing to use the Service after the change means you accept it.
  • Upgrades may be charged immediately or prorated at our discretion. Downgrades take effect at the next renewal and do not create any credit or refund.

7. No refunds

ALL PAYMENTS TO RCICMASTER ARE FINAL AND NON-REFUNDABLE. We do not issue refunds, credits, or pro-rated amounts under any circumstances, including (without limitation):

  • Monthly or yearly subscription fees, including renewals you forgot to cancel.
  • Partial billing periods, unused time, unused features, or unused seats.
  • Plan downgrades, cancellations, or account closures, whether made by you or by us.
  • LMS courses, exam prep courses, and other learning content, whether or not you have started or completed them.
  • Storage upgrades, add-ons, marketing services, setup services, and one-time purchases.
  • Charges made after a free trial converts to a paid plan.
  • Suspension or termination of your account for breach of these Terms.
  • Dissatisfaction with the Service, features you expected but did not use, or changes we make to the Service.

When you cancel, your subscription stays active until the end of the period you have already paid for, and it will not renew. Nothing is refunded for the remainder of that period.

Opening a chargeback or payment dispute for a valid charge is a breach of these Terms. We may suspend or close your account while the dispute is open and recover any dispute fees from you.

This section applies to the fullest extent permitted by applicable law. If a law that cannot be waived requires a refund in a particular case, the refund will be limited to the minimum amount that law requires.

8. Payments between you and your clients

If you use the Service to send payment requests, invoices, or retainer agreements to your clients, the contract and the money are between you and your client. RCICMASTER is not a party to that transaction, does not hold client funds, and is not responsible for collecting, refunding, or disputing those payments. You are solely responsible for your own refund policy, taxes, trust accounting, and any client disputes. Payment processing is provided by third parties such as Stripe and is subject to their terms.

9. Your data

You own the data you and your clients upload to the Service ("Customer Data"). You grant RCICMASTER a limited licence to host, copy, process, transmit, and display Customer Data only as needed to provide, secure, support, and improve the Service, and as described in our Privacy Policy and Data Processing Addendum. You are responsible for the legality, accuracy, and quality of Customer Data and for keeping your own backups of anything important.

We may use aggregated and de-identified information that does not identify you, your firm, or your clients to operate, analyse, and improve the Service.

10. Our intellectual property

The Service, including its software, design, templates, course content, text, graphics, logos, and the RCICMASTER name, is owned by RCICMASTER or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service during your paid subscription or trial, for your internal business purposes, in line with these Terms. Course materials are licensed for your personal use only and may not be copied, shared, or redistributed. If you send us feedback or suggestions, we may use them freely without any obligation to you.

11. Third-party services

The Service connects with third-party services such as Stripe, Google (sign-in, Calendar, and Meet), Microsoft, Zoom, WhatsApp, Twilio, email providers, AI providers, and government websites. Your use of those services is governed by their own terms. We are not responsible for third-party services, their availability, or any changes they make, and outages or changes on their side do not entitle you to a refund or credit.

12. Availability and changes

We work to keep the Service available and secure, but we do not promise that it will be uninterrupted, error-free, or available at any particular time. We may perform maintenance, and we may add, change, or remove features, integrations, templates, or courses at any time. We may also discontinue the Service; if we do, we will give reasonable notice where practical so you can export your data.

13. Suspension and termination

  • You may cancel at any time from your account settings or by emailing info@rcicmaster.ca. Cancellation stops future renewals; it does not trigger a refund.
  • We may suspend or terminate your account, with or without notice, if you breach these Terms, fail to pay, lose your licence or authorization to practise, create risk or legal exposure for us or others, or if required by law.
  • After your account ends, you may request an export of your Customer Data within 30 days. After that period we may delete Customer Data from active systems, except where we must keep it by law. Backups are deleted on their normal schedule.
  • Sections that by their nature should survive termination will survive, including sections 7 (No refunds), 8, 10, 14, 15, 16, and 18.

14. Disclaimer

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. RCICMASTER DOES NOT WARRANT THAT ANY FORM, TEMPLATE, CALCULATION, AI OUTPUT, LEGISLATION SUMMARY, OR IRCC NEWS ITEM IS ACCURATE, COMPLETE, OR CURRENT, OR THAT USING THE SERVICE WILL LEAD TO ANY IMMIGRATION RESULT.

15. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RCICMASTER AND ITS OWNERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, CLIENTS, GOODWILL, DATA, OR BUSINESS OPPORTUNITY, OR FOR ANY REFUSED, DELAYED, OR WITHDRAWN APPLICATION, PROFESSIONAL DISCIPLINE, OR CLAIM BY YOUR CLIENTS, EVEN IF WE WERE ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE AMOUNT YOU PAID TO RCICMASTER FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

16. Indemnity

You will defend, indemnify, and hold harmless RCICMASTER and its owners, directors, employees, and suppliers from any claims, losses, damages, fines, penalties, and costs (including reasonable legal fees) arising from your use of the Service, your Customer Data, your professional services, your relationship with your clients, your breach of these Terms, or your breach of any law or professional rule.

17. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page and update the date above, and for material changes we will notify you by email or in the dashboard. Continuing to use the Service after the effective date means you accept the updated Terms.

18. Governing law and general terms

  • These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. You agree to the exclusive jurisdiction of the courts located in Toronto, Ontario.
  • These Terms, together with the Privacy Policy, the Data Processing Addendum, and any order or plan details, are the entire agreement between you and us about the Service.
  • If any part of these Terms is found unenforceable, the rest remains in effect, and the unenforceable part will be applied to the greatest extent allowed.
  • Our failure to enforce a right is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, sale, or reorganization.
  • We are not liable for delays or failures caused by events beyond our reasonable control.
  • If these Terms are provided in another language, the English version governs.
